ZAP LOYALTY TERMS AND CONDITIONS
These Terms and Conditions (Terms) govern the ZAP Loyalty Module (ZAP Loyalty).
Overview
ZAP Loyalty is an online rewards module that allows a customer (ZAP User) to earn points (Store Points) and redeem the same with a partner-establishment of ZAP (ZAP Partner). ZAP Loyalty has been developed and is owned and operated exclusively by ZAP.
Store Points
For every transaction under the ZAP Loyalty module, a ZAP User shall earn Store Points based on the total price paid to Merchant and the amount of rebate or “cashback” agreed between ZAP and Merchant.
Store Points earned from an eligible transaction with Merchant can only be used or redeemed with the same Merchant (and not with any other ZAP Partner).
Store Points shall not be considered as cash or cash substitutes. Store Points have no cash or monetary value and cannot be exchanged for or withdrawn in cash.
All Store Points earned shall be credited to and reflected in the ZAP User’s ZAP Account after two (2) days from date of the transaction.
Unless otherwise provided by these Terms, Merchant shall determine the other terms and conditions of the Store Points issued by it, including validity, exchange or refund policy. Merchant shall be solely responsible for making known such terms and conditions to its customers and holders of its Store Points.
Recognition of ZAP Users
To use ZAP Loyalty, a ZAP User must present his registered mobile number to Merchant upon purchase of goods and/or services.
Redemption of Store Points
Upon presentation by a ZAP User of his registered mobile number, Merchant shall allow the ZAP User to redeem a portion or all of the Store Points in such user’s ZAP Account.
In the redemption of earned Store Points, the ZAP User shall be required to enter the Device using his account Personal Identification Number code or the One-Time Password sent via Short Messaging Service (SMS).
Authorization
Each transaction under the ZAP Loyalty module shall be covered by a confirmation message displayed on the Device (the Authorization).
Records and Documentation
ZAP shall provide Merchant with a Sales Summary Sheet which will be available daily online at www.zap.com.ph
Billing
Payment Terms. For paid services, all amounts indicated in the invoice are payable within seven (7) calendar days from receipt by Merchant (Due Date). ZAP shall have the right to stop all ZAP Loyalty services and other ZAP services being delivered to Merchant (without further notice) if any invoiced amount remains unpaid thirty (30) calendar days after Due Date.
Contested Invoice. An invoice is deemed accepted after the lapse of five (5) days from receipt thereof, unless ZAP receives a notice in writing that Merchant contests the invoice (the Contesting Party).
Termination
Upon the termination of the Agreement, Merchant shall no longer have access to ZAP Loyalty, its software and the ZAP Loyalty App.
Limitation of Liability
ZAP shall only be responsible for providing and maintaining the ZAP Loyalty module as well as allowing Merchant access and use of the ZAP Loyalty module.
Merchant shall be solely responsible for Store Points issued by it. Merchant shall honor Store Points that are validated by the Device (as evidenced by an Authorization) under the ZAP Loyalty module. In no case shall ZAP be liable for Store Points obtained due to the fault or negligence of Merchant or when no Authorization is reflected in the Device.
